Terms of Service

Rules and guidelines for using the Bubupo app and services

1. Acceptance of Terms

By downloading, installing, or using the Bubupo mobile application ("App") and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Bubupo provides a platform for users to create custom doll orders. Users upload photos, communicate with an AI advisor to specify requirements, preview generated artwork, and place orders for handcrafted custom dolls. The Service includes order tracking, shipping, and after-sales support.

3. User Accounts

Upon first use, the App automatically creates an anonymous guest account for you. You are responsible for maintaining the security of your device and account. You may edit your profile information within the App. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content and Conduct

4.1 Uploaded Photos

By uploading photos to the Service, you represent and warrant that:

  • You own the photos or have obtained all necessary rights and permissions to upload and use them.
  • The photos do not infringe upon any third party's intellectual property, privacy, or publicity rights.
  • The photos do not contain illegal, harmful, or otherwise objectionable content.
  • If the photo contains a recognizable person, you have obtained that person's consent.

We reserve the right to reject or remove any content at our sole discretion.

4.2 Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws.
  • Upload photos containing minors without proper parental or guardian consent.
  • Upload content that is obscene, defamatory, harassing, or otherwise objectionable.
  • Attempt to reverse engineer, decompile, or extract the source code of the App.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Use automated means (bots, scrapers) to access or interact with the Service.

5. Orders and Payment

5.1 Order Confirmation

An order is confirmed only after successful payment. The preview image shown before payment is an AI-generated approximation; the final handcrafted doll may have reasonable variations in color, texture, and detail.

5.2 Pricing and Payment

All prices are displayed in the App. Payment is processed through Apple In-App Purchase. You agree to pay all charges associated with your order. Prices are subject to change, but changes will not affect confirmed orders.

5.3 Cancellation and Refunds

  • Orders may be cancelled before production begins. Once production starts, cancellation may not be possible.
  • Refunds for quality issues are handled on a case-by-case basis. We offer free remake for manufacturing defects.
  • Subjective dissatisfaction with style or aesthetics is not eligible for refund, as preview images are provided for approval before payment.
  • Apple In-App Purchase refunds are subject to Apple's refund policies.

6. Intellectual Property

6.1 Our IP

The App, its original content (excluding user content), features, and functionality are owned by Bubupo and protected by international copyright, trademark, and other intellectual property laws.

6.2 User Content License

By uploading photos, you grant us a limited, worldwide, royalty-free license to use, reproduce, and modify the photos solely for the purpose of providing the Service to you (i.e., generating previews and producing your doll). This license terminates upon deletion of your photos or your account.

7. Limitation of Liability

To the maximum extent permitted by law, Bubupo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the specific order giving rise to the claim.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

8. Service Availability

We strive to maintain high availability but may occasionally need to perform maintenance or experience service interruptions. We are not liable for any damages resulting from service unavailability.

9. Third-Party Services

The Service integrates with third-party AI providers for chat and image generation. We are not responsible for the content, accuracy, or availability of these third-party services. Your use of these services through our App is subject to their respective terms and policies.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. You may stop using the Service at any time.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in Hong Kong.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or website. Continued use after changes constitutes acceptance. It is your responsibility to review these Terms periodically.
